 Purse Money Platform LTD Terms & Conditions

These Terms & Conditions Agreement (“Agreement”) is a legally binding contract between you ("Customer," "you," or "your") and Purse Money Platform LTD ("Purse Money," "we," "us," or "our"). This Agreement governs your use of the services provided by Purse Money, including access to our website, mobile applications, and other related services (collectively, the "Services"). By using our Services, you agree to be bound by the terms and conditions of this Agreement. 

 

1. Acceptance of Terms 

By accessing or using our Services, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions of this Agreement. If you do not agree with any provision of this Agreement, you should not use our Services. This Agreement incorporates by reference our Privacy Policy and any other policies or guidelines made available to you within the Services. 

 

2. Eligibility 

To use our Services, you must be at least 18 years old and have the legal capacity to enter into this Agreement. By using our Services, you represent and warrant that you meet these eligibility requirements. If you are accessing or using our Services on behalf of a legal entity, you further represent and warrant that you have the authority to bind that entity to this Agreement. 

 

3. Services Description 

Purse Money provides financial services, including money transfer, payments, currency exchange, and related services. The availability of specific services may be subject to eligibility requirements, geographic restrictions, and regulatory compliance. We reserve the right to modify, suspend, or terminate any part of our Services at any time without prior notice. 

 

4. Account Registration and Security 

To access and utilize specific features or services within our platform, it is necessary for you to create an account. By doing so, you agree to the following terms: 

Account Creation: You agree to provide accurate, current, and complete 

information during the registration process. It is your responsibility to ensure that the 

information you provide remains accurate and up to date. Failure to do so may result in the suspension or termination of your account. 

Account Security: You are solely responsible for maintaining the confidentiality of your account credentials, including your username and password. You understand that you are responsible for all activities that occur under your account. If you become aware of any unauthorized use or suspect a breach of security, you must promptly notify us. 

Unauthorized Use: You acknowledge that you will not permit any third party to access or use your account. You understand and agree that Purse Money will not be liable for any loss or damage arising from unauthorized access or use of your account. 

User Responsibilities: You are responsible for maintaining the security of your account and any devices used to access our Services. You must take appropriate measures to protect against unauthorized access, such as using strong passwords, enabling two-factor authentication when available, and keeping your account information confidential. 

Compliance with Policies: You agree to comply with all applicable laws, regulations, and our policies, including this Customer Agreement and any additional guidelines or rules provided within our Services. 

We reserve the right to suspend or terminate your account if we have reasonable grounds to believe that you have violated any provision of this Agreement or engaged in any fraudulent, illegal, or unauthorized activities. 

 

5. Use of Services 

By using our Services, you agree to the following terms regarding the use of our platform: 

Compliance with Applicable Laws and Regulations: You agree to use our Services in full compliance with all applicable laws, regulations, and this Agreement. It is your responsibility to ensure that your use of our Services is legal and does not violate any laws or regulations in your jurisdiction. 

Prohibited Activities: You shall not use our Services for any illegal, fraudulent, or unauthorized purpose. You acknowledge and understand that engaging in such activities may result in the immediate suspension or termination of your account. Prohibited activities include, but are not limited to, money laundering, terrorist financing, fraud, unauthorized access to systems or accounts, and any other activities that violate applicable laws or regulations. 

Additional Terms and Conditions: Certain activities within our Services, such as currency exchange, payment processing, or compliance with anti-money laundering and anti-fraud laws, may be subject to additional terms and conditions. It is your responsibility to familiarize yourself with and adhere to these additional terms and conditions when engaging in such activities. 

User Obligations: You are solely responsible for your actions and the consequences thereof while using our Services. You agree not to use our Services in a manner that could harm, interfere with, or disrupt the operation of our platform or the experience of other users. You shall not engage in any activity that could damage, disable, overburden, or impair the functionality or security of our Services. 

Lawful Use of Services: You acknowledge and agree that the use of our Services shall be for lawful purposes only. You shall not use our Services to engage in any activity that violates the rights of others or is contrary to ethical standards. 

We reserve the right to monitor your use of our Services to ensure compliance with this Agreement and applicable laws. In the event that we have reasonable grounds to believe that you have violated any provision of this Agreement or engaged in any illegal or unauthorized activities, we may take appropriate actions, including the suspension or termination of your account and the reporting of such activities to relevant authorities.

 

6. Intellectual Property 

Intellectual property rights pertaining to our Services, which encompass trademarks, logos, service marks, software, and content, are the sole and exclusive property of Purse Money or its licensors. You are strictly prohibited from engaging in any of the following activities without obtaining our prior written consent: 

Use: You shall not use, exploit, or make any commercial use of the intellectual property belonging to Purse Money without express authorization. This includes the use of trademarks, logos, service marks, or copyrighted material in any manner that implies an association or endorsement without our explicit consent. 

Copying: You shall not copy, reproduce, or duplicate any intellectual property belonging to Purse Money, whether in whole or in part, by any means or in any form. 

Modification: You shall not modify, alter, adapt, translate, or create derivative works based on the intellectual property owned by Purse Money, unless expressly permitted by applicable law or with the written consent of Purse Money. 

Distribution: You shall not distribute, sublicense, sell, rent, lease, or otherwise transfer any intellectual property belonging to Purse Money to any third party without obtaining our prior written consent. 

Any unauthorized use, reproduction, distribution, or modification of our intellectual property constitutes a violation of our rights and may result in legal action being taken against you. Purse Money reserves all rights not expressly granted in this Agreement. 

If you believe that any of your intellectual property rights have been infringed upon by our Services or any content contained therein, please promptly notify us in writing, providing the necessary details and evidence of the alleged infringement. We will investigate such claims and take appropriate actions in accordance with applicable laws and regulations. 

 

7. Limitation of Liability 

To the maximum extent permitted by applicable law, Purse Money and its affiliates, officers, directors, employees, agents, and partners shall not be held liable for any indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of our Services, regardless of the cause of action or theory of liability. This limitation of liability applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other legal basis. 

By using our Services, you acknowledge and agree that any risk associated with the use of our Services is assumed solely by you. Purse Money and its affiliates shall not be held responsible for any damages, losses, or expenses incurred by you, including but not limited to: 

Indirect Damages: We shall not be liable for any indirect or consequential damages, including loss of profits, loss of revenue, loss of data, or loss of business opportunities, arising from your use or inability to use our Services. 

Incidental Damages: We shall not be liable for any incidental damages, including damages resulting from any interruption, suspension, or termination of our Services, or from any loss of access to or use of your account. 

Special Damages: We shall not be liable for any special damages, including damages arising from the unauthorized access to or use of your personal information, or damages resulting from the reliance on any information or content provided through our Services. 

Consequential Damages: We shall not be liable for any consequential damages, including damages resulting from any delay, interruption, or failure in the operation or availability of our Services, or damages arising from any errors or omissions in the content provided through our Services. 

This limitation of liability shall apply to the fullest extent permitted by applicable law, regardless of whether we have been advised of the possibility of such damages. In the event that any exclusion or limitation of liability is found to be unenforceable, our total liability to you for any claims arising out of or in connection with your use of our Services shall not exceed the amount paid by you, if any, for accessing or using our Services. 

Some jurisdictions do not allow the exclusion or limitation of liability for certain types of damages, so the above limitations may not apply to you to the extent prohibited by law.

 

8. Privacy and Data Protection 

Purse Money respects your privacy and is committed to protecting your personal information. Our collection, use, and disclosure of personal information are governed by our Privacy Policy, which is incorporated by reference into this Agreement. By using our Services, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy.

 

9. Governing Law and Dispute Resolution 

This Agreement shall be governed by and construed in accordance with the laws of the province of British Columbia, Canada, without regard to its conflict of laws principles.Any disputes arising out of or in connection with this Agreement shall be resolved through binding arbitration conducted in accordance with the rules of the British Columbia International Commercial Arbitration Centre.The arbitration shall take place in the province of British Columbia, Canada and the arbitrator's decision shall be final and binding. The language of the arbitration shall be English. 

 

10. Amendments and Modifications 

Purse Money reserves the right to modify, amend, or update this Agreement at any time, in its sole discretion, without prior notice. Any changes to this Agreement will be effective immediately upon posting the updated version on our website or notifying you through other means such as email. It is your responsibility to review this Agreement periodically for any changes. By continuing to use our Services after the updated Agreement has been posted, you agree to be bound by the revised terms. 

 

11. Termination 

You may terminate this Agreement at any time by ceasing to use our Services and closing your account, subject to any outstanding obligations or liabilities. Purse Money reserves the right to suspend or terminate your access to our Services, in whole or in part, for any reason and without prior notice, including but not limited to violations of this Agreement or any applicable laws. 

 

12. Entire Agreement 

This Agreement constitutes the entire agreement between you and Purse Money concerning the subject matter hereof and supersedes all prior or contemporaneous agreements, understandings, or representations, whether oral or written. Any waivers, modifications, or amendments to this Agreement must be in writing and signed by both parties. 

 

13. Severability 

If any provision of this Agreement is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue to be valid and enforceable to the fullest extent permitted by law. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that most closely reflects the intent of the original provision. 

 

14. Waiver 

The failure of Purse Money to enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision unless acknowledged and agreed to in writing by Purse Money.
